Terms of Use

These Terms of Use ("Terms") govern your access to and use of the GeckoGrain website at geckograin.com and the related custom cutting board service (the "Service") operated by GeckoGrain ("we", "us", "our"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By using the Service you represent that you meet this requirement and have the legal capacity to enter into a contract.

2. Accounts

You are responsible for keeping your credentials confidential and for activity on your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

3. Orders, pricing, and deposits

  • Final price is calculated at checkout based on size, wood combination, and inlay complexity, and shown before payment.
  • A non-refundable 50% deposit is required to confirm each order. The balance is due before shipping.
  • Because every board is hand-built to your specifications, orders cannot be cancelled or refunded once production has begun, except where required by applicable consumer law.
  • We may refuse or cancel any order; if we do, we will refund amounts paid for the cancelled order.
  • Prices and lead times may change without notice.

4. AI-generated inlay designs

The Service uses a third-party AI model to generate inlay options from the prompt you provide. You are responsible for the prompts you submit. You may not submit prompts that are unlawful, infringing, sexual involving minors, or otherwise in violation of section 6. We do not warrant that generated designs will be unique, original, or free of similarity to existing works.

5. Handmade products

Each board is hand-built from natural wood. Grain, color, and exact dimensions will vary from photos and from the 3D preview. These variations are part of the craft and are not defects. Boards must be hand-washed, dried promptly, and oiled regularly; failure to do so voids any goodwill remake.

6. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose or in violation of these Terms;
  • submit content that is infringing, defamatory, hateful, harassing, sexually explicit, violent, or otherwise objectionable;
  • attempt to gain unauthorized access to the Service or its data;
  • interfere with the operation of the Service, including by automated scraping or denial-of-service attacks;
  • use the Service to build a competing product.

7. Intellectual property

The Service, including the site design, text, logos, photographs, and software, is owned by GeckoGrain or its licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. You retain rights to the prompt text you submit; you grant us a worldwide, royalty-free license to use, store, and display the prompt and the generated inlay artwork to fulfil your order and to showcase finished pieces in our gallery (without associating gallery pieces with your name or other personal data without your consent).

8. Third-party services

The Service relies on third parties such as payment processors, hosting providers, email providers, and AI model providers. Your use of those services is also governed by their terms and privacy policies.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GECKOGRAIN AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless GeckoGrain from any claim, demand, loss, or liability arising out of your use of the Service, the prompts you submit, or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms. Sections that by their nature should survive termination will do so.

13. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which GeckoGrain is established, without regard to conflict-of-law principles. Any dispute will be resolved exclusively in the competent courts of that jurisdiction, except where mandatory consumer-protection law gives you the right to bring proceedings in your country of residence.

14. Changes to these Terms

We may update these Terms from time to time. We will post the new version with an updated "Last updated" date and, where changes are material, notify you by email or in-app notice. Your continued use of the Service after the new Terms take effect constitutes acceptance.
